Disability Benefit Claims in the Notice Period: Issues of Entitlement to Benefits and Double Recovery

The paper essentially explores two issues: whether a terminated employee, who becomes disabled during the reasonable notice period, is entitled to recover damages from his/her employer for the loss of those disability benefits, and whether a terminated employee can claim damages for both wrongful dismissal and disability benefits.
