CLEBC Papers On Real Estate Litigation
Posted on May 10, 2016
These papers cover two topics. The first deals with an introduction to the arbitration process as it would apply to real estate matters and how it can be designed by the parties to efficiently resolve disputes. The second deals with the valuation of real estate interests through the use of expert appraisal opinion evidence, approaches to valuation, common appraisal issues, how to properly instruct an appraiser, strategies for review of appraisal opinions, and the cross examination of appraisers in valuation cases (e.g. the valuation of market rent for a rent review or renewal under a commercial lease or the valuation of a fee simple interest in an expropriation of land).
