A recent hit-and-run incident involving a cyclist in Nanaimo, BC, is a reminder that the Motor Vehicle Act needs to be amended to be more inclusive of vulnerable road users. David Hay, K.C., Practice Group Leader of our Personal Injury Group and Chair of the BC Road Safety Law Reform Group, said “the law is currently silent on a safe passing distance, which makes things difficult to interpret for everyone from drivers to judges.” The BC Road Safety Law Reform group is recommending a Safe Passing Law which requires motorists to give at least 1.5 metres of space when passing cyclists, pedestrians or wheelchairs on the road.
